Terms & Conditions
1. In this contract, the owner (bailor) of the goods (vehicle) parts temporarily with possession of the goods and The Brand Family accept temporary custody of the goods.
2. The Brand Family have appropriate security measures in place to minimise the risk of theft or damage, but is impossible to eliminate this entirely. It is therefore the responsibility of the owner to ensure that appropriate insurance is in place for the duration of their storage period to protect against any such losses, and that any special requirements or conditions associated with their insurance policy are adhered to whilst in our custody. The Brand Family will not accept liability for theft or damage to a vehicle unless caused by negligence of The Brand Family or one of its employees. It is therefore advisable that customers inspect the storage facility to ensure they are satisfied with the level of security provided.
3. Windows and doors should be locked and all personal effects and valuables removed from the vehicle.
4. All gas bottles to be removed from the caravan and no other noxious, dangerous, hazardous or explosive goods are permitted on site. In the event that gas bottles cannot be removed, they must be switched off and The Brand Family informed in order to comply with fire safety regulations.
5. Access to the site is between the hours of 8am and 8pm. Access at any other time is by arrangement.
6. All vehicles to be parked with the driver’s rear corner in line with the storage pitch number, in order to maintain safe and correct distances from other vehicles.
7. The owner must keep their allocated storage plot free of any personal debris and litter.
8. No trading is permitted from the site. Vehicles should not be offered or advertised for sale whilst stored on site without the prior knowledge and permission of The Brand Family. If permission is granted to sell a vehicle whilst in storage, for security reasons, The Brand Family must be informed of the date and time of any perspective buyer viewings and final collection date and time once sold. In the case of a change of ownership, the vehicle owner is not guaranteed to retain the storage plot held by the previous owner.
9. Owners are only permitted to access the storage area for the collection and return of vehicles. They must not be used whilst in the storage area.
10. No major repairs are permitted to be carried out on site without the prior knowledge and permission of The Brand Family. Minor repairs and professional cleaning is permitted, but must be communicated to The Brand Family in advance with details of the work required, company undertaking it, and the dates and times they will be onsite.
11. The storage fee set out in the contract is payable in advance and due prior to the commencement of storage. This storage fee is non-refundable. The Brand Family has the right to alter the storage agreement by giving due notice to the plot holder. In this instance, a pro-rata refund will be issued from the termination date to the storage end date.
12. In the event of the storage fee being overdue, The Brand Family may retain possession (lien) of the vehicle until the arrears are settled in full or otherwise discharged. The Brand Family undertakes to notify possession by recorded delivery.
13. In the event of a negative response to possession, legal action may be taken to sell the vehicle via The Torts Interference with Goods Act 1977. The Outstanding arrears will be deducted from the proceeds of the sale, as will any reasonable costs incurred. The remaining balance will be retained to await collection. The Brand Family will seek to obtain the best price available based on current market values and notify the owner of the date and place of sale.
14. The Brand Family excludes all liability caused by vermin infestation. A recognised vermin control measures are in place and is monitored regularly. To assist with our vermin control measures, owners must remove food sources from vehicles whilst in storage.
15. In the performance of this agreement, The Brand Family will at all times act with due diligence in providing a fit and proper place for the storage of vehicles.
16. Periodic checks may be made on the identity of all vehicles stored on site.
17. Any changes to the details provided by the plot holder in this Agreement to be notified to The Brand Family without undue delay.
